Tornatore v Kraber
Plaintiff Tornatore , age 76, was taking a walk in the Seven Oaks Community in San Diego when she passed by our client Jean Kraber’s home and noticed a “For Sale” sign. Tornatore stepped off the sidewalk and went four feet up a slight incline to retrieve a flyer from a brochure box attached to the signpost that was situated in a rock garden. After she retrieved the brochure, she turned to go down the incline and fell which resulted in her breaking her L1 vertebrae. She then sued both Kraber and Century 21. Plaintiff’s original demand was $1,000,000.00. We made an offer of $20,000 before trial which Plaintiff rejected. The jury returned a defense verdict for Kraber and it was a hung jury 8-4 for Century 21.
