Plaintiff was an elderly woman living at a nursing home out for a walk in a neighborhood in San Diego. While walking by our client’s house, she noticed a “For Sale” sign and sales brochures placed there by Century 21. Even though she did not intend to buy this property, she decided to pick up the brochure when she fell on our client’s property. She suffered a broken pelvis. We received 8-4 defense verdict for our clients the homeowners. The case against Century 21 (not our client) resulted in a hung jury and was re-tried.
