Sung v. Hahn, et al.

Facts: Plaintiff, buyer of an internet café, brought an action for misrepresentation against our client, a commercial real estate agent, for allegedly misrepresenting the terms of the lease for the café.

Result (Trial Court): After being given multiple opportunities to amend the complaint following demurrers we filed on the client’s behalf (and sustained by the court), the plaintiff and his assignee failed to file a third amended complaint. The court thereafter granted our motion to dismiss.

Result (Court of Appeal): The assignee appealed. The Court of Appeal heard oral argument and sustained the trial court’s dismissal of our clients.

Result (California Supreme Court): The California Court of Appeal denied the assignee’s petition for review.

Note: RJM drafted the motions/briefs and orally argued the same before the trial court and Court of Appeal.
