Facts: The plaintiff in this Nevada action crashed his car after driving through a large puddle. The plaintiff alleged that construction workers in the area failed to properly maintain a filtering device surrounding a storm drain inlet, causing the puddle to form. The plaintiff filed suit against our clients, the construction company and the landowner. We filed, and prevailed on, a motion for summary judgment based on the plaintiff’s failure to make a prima facie case for negligence (specifically, the plaintiff had no evidence to support the elements of duty and breach).
