Although our favorable independent witness ducked service and wouldn’t show up at trial, the jury only returned a verdict for $1700, assessing 60% comparative negligence against the Plaintiff. Our cost bill was larger and our offer under CCP section 998 was even higher, so no money will pass to the plaintiff as a result of the verdict.
