Premises Liability/Medical Malpractice. We defended homeowners whose dog escaped and was approached by the plaintiff, who tried to grab its collar and was bitten on the wrist. When she was taken to a local emergency room, plaintiff suffered increased injury because the emergency room doctor failed to guard against infection when sewing shut the modest incision caused by the dog bite. The resulting infection caused her to be hospitalized and undergo an operation to rectify the damage. We tried the cross-complaint we brought against the facility and the emergency room doctor after reaching a sliding-scale settlement with the plaintiff. A modest settlement was achieved against the facility, but the jury found for the cross-defendant doctor.
