Dangcil v. Countrywide Financial Corporation, et al.
Facts: Plaintiff homeowners sued persons and entities involved in Plaintiffs’ purchase of residential property, including real estate agents and brokers, mortgage brokers, and the client appraiser, for fraud and misrepresentation as to the value of the residence.
Result: We filed multiple demurrers on the client’s behalf. The court gave the plaintiffs opportunities to amend their pleadings, but were still unable to make out a cause of action against the client, a real estate appraiser hired by the mortgage lender. Our demurrer to the plaintiffs’ amended complaint was subsequently sustained, without leave to amend, and the client was dismissed.
Note: RJM drafted and argued the demurrers.
