Spriggs v. Landmark Homes and Development, Inc., et al

Facts: Plaintiff crashed his car after driving through a large puddle. Plaintiff alleged that construction workers in the area failed to properly maintain a filtering device surrounding a storm drain inlet, causing the puddle to form. Plaintiff brought an action in Nevada against our clients, the construction company and the landowner.

Result: We prevailed on a motion for summary judgment based on Plaintiff’s failure to make a prima facie case for negligence (specifically, Plaintiff had no evidence to support the elements of duty and breach).
