DUFFY v. ARAMARK
Trucking/Personal Injury. The plaintiff was a postal employee whose only job was to mail placebo letters, due to her extensive pre-existing physical problems that at one time had caused her to be discharged from the military. Our client’s truck rear-ended her when the driver fell asleep and rolled forward at a stop sign, so she claimed that she could never work again. With the help of Judge Victor Barrerra, we got her to stipulate to a bench trial in front of Judge Julius Title. She claimed $800,000, but was awarded $26,000, after which she refused to sign the check. We argued for awhile about whether our $30,000 CCP 998 offer applied, then gave in and tried to pay. This was a situation never covered in law school. I think almost a year went by before she would endorse the check.
